We are a licensed Unlawful Detainer Assistant business - licensed in the state of California to help the public with the ministerial tasks involved in filing an eviction  case.

We are a “Self-help Service” business for those who wish to litigate their own claims, yet prefer or require ministerial assistance such as typing forms, filing documents at the courthouse or electronically, and arranging for service of process.  

As a “Self-help Service” we provide our clients general published factual information pertaining to unlawful detainer procedures, rights, or obligations.  We also provide access to the forms adopted by the Judicial Council specifically for unlawful detainer claims, and other helpful published legal documents for  self-litigants.

Put another way, you make all the substantive decisions while our job is to turn your decisions into documents that get filed with the court.

Many unlawful detainer claims are beyond the scope of what a “Self-help Service” can legally and practically assist with, and we promise to let you know when your claim requires the services of an attorney.

Nonetheless, we encourage and champion those who wish to save themselves fistfuls of money by accessing the justice system as a self-litigant.

Remember - it's a process!

Although evictions in California are intended to be "speedy" summary proceedings - and is the fastest civil trial proceeding in California - it is still a process. Since COVID-19, the process takes longer in most jurisdictions. The sooner you start, the sooner you'll be done!

Landlords are under attack.

There's no other way to say it. The moratorium really put the squeeze on landlords, and if some of our elected leaders have their way, landlords will be prevented from accessing the credit reports of potential tenants. Here at North State Eviction, we understand your frustration.

Is Small Claims Right For You?

Have you considered bringing a Small Claims case against your tenant? These are the things you should know:

  • Whether your tenant has moved or still lives on the property, you can obtain a judgment against your tenant for rent that came due during the COVID-19 moratorium - or at any time.

  • The normal cap for Small Claims is $10,000, but the cap has been lifted for landlords who lost rental income during the moratorium.

  • If you applied for Rental Assistance, but received no funds, you can file a Small Claims case today, no matter how much money your tenant owes you.

  • Securing a Small Claims judgment against your tenant allows you to legally require your tenant provide information concerning their employment, bank accounts, and other assets.

  • Even if your tenant does not have the ability to pay at this time, securing a judgment by recording an abstract of judgment with the County Recorder assures that your tenant will need to pay the judgment before buying real estate - no matter how far into the future that might be.

  • Small Claims cases are inexpensive and informal; the filing fee is $30, $50 or $75, depending on the amount of your claim.

  • Small Claims cases are intended to be simple procedures that allow anybody access to the court system, but the reality is that it can still present a challenge to the first time user.  We can help with preparation of forms, electronic and in-person filing, and service of process.

  • Our fee to get you to the judgment stage is $299 - excluding filing and service fees.
